Read carefully the following General Conditions of Use (hereinafter referred to as "Conditions"), as they provide important information on the obligations, regulations and use of the Services (as defined below) offered by Italianstories (as defined below). Registration and use of the Services implies the acceptance and legal binding of the terms and conditions established therein. These Conditions govern the access and use of the Website, the Application and the Services and constitute a binding agreement between you and Italianstories. Please also read our Privacy Policy carefully.

THE WEBSITE AND THE SERVICES OFFERED ARE SUBSTANCED IN AN ONLINE PLATFORM THROUGH WHICH ARTISANS (AS DEFINED BELOW) CAN CREATE ANNOUNCEMENTS RELATING TO THEIR EXPERIENCES AND VISITORS CAN INFORM AND BOOK THESE EXPERIENCES DIRECTLY. YOU UNDERSTAND AND AGREE THAT ITALIAN STORIES IS NOT PART OF ANY CONTRACT STIPULATED BETWEEN ARTISANS AND VISITORS, BUT IT IS LIMITED TO RELATING TO THEM FOR THE PURPOSE OF THE CONCLUSION OF THIS CONTRACT, WITHOUT ANY BINDING OF COLLABORATION, DEPENDENCE OR REPRESENTATION WITHOUT RESPECT. ITALIANSTORIES HAS NO CONTROL OVER THE CONDUCT OF THE CRAFTSMEN, VISITORS AND OTHER USERS OF THE SITE, THE APPLICATION AND THE SERVICES OR OVER ANY EXPERIENCE AND EXCLUDES ALL LIABILITY IN THIS SENSE TO THE MAXIMUM LIMITS PERMITTED BY LAW.

IF YOU DO NOT INTEND TO ACCEPT ONE OR MORE OF THE SPECIFIC CONDITIONS PRESENT, YOU CANNOT USE OUR SERVICES.

1. OWNER OF THE PORTAL
Who we are?

These Conditions govern the access and use of the Service through the web portal www.italianstories.it by the User (as defined below). Italian Stories is the commercial name of IS s.r.l.s., a company registered in the Trento business register, REA 217388, VAT no. 02338210228 and whose registered office is in Viale Rovereto 13 / B - Riva del Garda (TN).

2. DEFINITIONS
Some definitions to better understand our conditions.

For the purpose of enforcing these Terms, the following definitions apply:

• Announcement: every single activity offered by the Artisan through the Site;

• Artisans: all professionals, experts, designers, makers who create an advertisement through the Portal;

• Visitor's Commission: the costs that Italianstories charges the Visitor for the use of the Service which are calculated as a percentage of the Total Price of the Experience. The Commission is displayed by the Visitor before sending the booking request;

• Artisan's Commission: the costs that Italianstories charges the Artisan for the use of the Service calculated as a percentage of the Experience Price. The Commission is displayed by the Artisan when he is asked to confirm or reject a booking request by a possible Visitor;

• Conditions: General Terms and Conditions of Use that legally regulate the functioning of the Site;

• Consumer: any natural person who uses the Portal for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out;

• Contents: all the data, information, texts, photos, videos that Italianstories makes available within the Site and makes it accessible to Users;

• Credentials: User ID and password that the User chooses when registering on the Portal;

• Experience: set of activities chosen by the Visitor from among the Announcements proposed by the Artisan;

• Event: set of activities proposed by Italian Stories through one's personal profile;

• Italianstories: (Owner) the company that holds the ownership of the website www.italianstories.it and that is responsible for connecting the Visitors with the Artisans, promoting the activities proposed by the latter through the Portal itself;

• Portal: (Platform, Site or Marketplace) Italian Stories platform operating at www.italianstories.it;

• Price of the Experience: expense payable by the Visitor to the Artisan for the use of the activities that make up the Experience. The amount of this price is determined exclusively by the craftsman. The Price of the Experience is understood to be all-inclusive of any taxes (eg VAT) as well as tax and contribution charges that will be borne by the Craftsman;

• Total Price of the Experience: sum of the Price of the Experience and the Visitor's Commission;

• Professional: any natural or legal person who uses the Portal in the exercise of their business, commercial, craft or professional activity;

• Registration: action by which the User accepts the Conditions of the Portal and obtains access to all the features of the same;

• Service of the Marketplace (Services): indicates the Service granted by Italianstories through the online platform that allows Artisans to publish Announcements and Visitors to book Experiences;

• Transactions: contracts that the Artisans conclude with the Visitors for the purchase of Experiences;

• Users: subjects (Artisans and Visitors), natural persons, who complete the registration process of the Italianstories account and use the Portal to use its Services, having accepted these Conditions;

• Visitors: Users who request an Artisan to book an Experience proposed through the Portal.

3. SERVICE OFFERED
Our aim is to connect people and territories through unique and tailor-made experiences, connecting travelers and onlookers from every corner of the world with the laboratories and interpreters of true Italian manufacturing.

Italianstories makes available a virtual platform with related technology so that artisans and visitors can meet online and agree to book experiences directly with each other. Unless expressly indicated otherwise on the Portal, the responsibilities of Italianstories are limited to: (i) making the Portal and the related Services available and (ii) acting as a representative for the collection of payments from Visitors in the name and for account of the Craftsman.

The Portal and the Services can be used to facilitate the publication of Announcements and the booking of Experiences. These Experiences are included in the Announcements of the Portal, the Application and the Services by the Artisans. You can view the Ads as an unregistered visitor, however, if you want to book an Experience, you must register as a User. Only Artisans who have been enabled for this functionality of the Service by Italianstories can create Advertisements, according to the methods established by the latter.

BY MAKING YOUR RESERVATION THROUGH ITALIANSTORIES.IT, YOU WILL ESTABLISH A DIRECT CONTRACTUAL RELATIONSHIP (BINDING IN LEGAL TERMS) WITH THE ARTISAN PROPOSER OF THE OFFER. FROM THE MOMENT OF THE ABOVE BOOKING, THE PORTAL DOES NOT PARTICIPATE OR CARRY OUT ANY INTERMEDIATION ACTIVITIES IN THIS RELATIONSHIP, LIMITING ITSELF TO FACILITATING THE USE OF THE PLATFORM.

THE SITE, THE APPLICATION AND THE SERVICES ARE INTENDED TO BE USED TO FACILITATE THE INTERACTION BETWEEN ARTISANS AND VISITORS AND THE BOOKING OF EXPERIENCES DIRECTLY BETWEEN THEM. ITALIANSTORIES DOES NOT CONTROL AND CANNOT CONTROL THE CONTENT INCLUDED IN THE ADS NOR THE CONDITION, LEGALITY OR SUITABILITY OF ANY EXPERIENCE. ITALIANSTORIES IS NOT RESPONSIBLE AND EXCLUDES ANY LIABILITY IN RELATION TO ALL ADS AND EXPERIENCES. CONSEQUENTLY, ANY RESERVATION WILL BE MADE AT THE EXCLUSIVE RISK OF THE USER.

4. REQUIREMENT OF MAJOR AGE
We are sorry, but you cannot use the service if you are a minor.

The Services offered by Italianstories are not intended for children under eighteen (18) years of age. By accessing or using the Portal, the User declares and guarantees that he is of age and that he has the necessary legal capacity to book the offers, thus fully accepting the content of these Conditions.

5. RULES OF CONDUCT AND USER OBLIGATIONS
Please respect the rules and purposes of the site, so that no one will have problems.

The User undertakes to use the Site and its functions and Services exclusively for lawful purposes and in accordance with these Conditions, assuming any consequent responsibility in this regard and undertaking to indemnify Italianstories from any third party claims in relation to the same.

If Italianstories finds by the User a use of the Portal and / or the Service contrary to the applicable legislation or to the Conditions, or in the event of a report by the Public Authority or third parties, Italianstories may, at its sole discretion, take any action useful to limit harmful consequences, including the suspension / cancellation of the User's account.

The User is prohibited, either for himself or on behalf of someone:

• use Italianstories for illegal, illicit or unauthorized purposes or that may infringe any third party rights, including industrial / intellectual property rights, privacy rights, etc ...;

• impersonate someone else's identity, hide one's identity or directly or indirectly provide false information;

• carry out propaganda, sponsorship, advertising or commercial activities of a professional nature, even indirectly, through the Portal;

• publish, send or disseminate, through Italianstories any content that is illegal, defamatory, harassing, threatening, religious, racist, obscene, vulgar, sexual, pornographic, harmful to the personal dignity or rights of children, and in 

Last analysis everything that violates the current legality or any behavior that causes or constitutes a crime;

• spreading viruses or other files that may cause damage or limit the functioning of the Services or of Software and Hardware devices, including those of third parties;

• copy, modify, alter in any way any section of Italianstories;

• scale up Italianstories by forwarding the personal data contained (email, telephone numbers, websites, etc.) to other users of the Portal;

• cause harm to third parties or other Users.

The User assumes all responsibility for the Contents published by him, undertaking to hold Italianstories harmless from any third party claims in relation to the same.

The publication of User Content on the Portal takes place without any activity or prior control by Italianstories, therefore the publication does not imply any approval or endorsement by the latter. Italianstories will not be responsible for the User Contents, including those present in the Advertisements and, by way of example only, for their legality, truthfulness, correctness, respect for the industrial and / or intellectual property rights of others, and for the rules on protection. of personal data. Furthermore, Italianstories will not be responsible for any loss or cancellation of User Content.

If the User violates one of the above rules, or Italianstories can reasonably suspect that the User has violated any of the aforementioned, the Owner reserves the right, at any time and without prior notification, to modify or suspend the account. of the User and to deny access and use of the Portal Services in the present and in the future.

Italianstories reserves the right to link the visibility of the Artisan's profile to the actual presence of one or more Experiences connected to the profile itself.

By publishing their Content on the Portal, the User concurrently grants Italianstories a non-exclusive, perpetual and free license to use the User Content, including, but not limited to, for commercial purposes.

6. INTELLECTUAL PROPERTY RIGHTS
Please do not copy our content without our permission.

The Contents present on the Portal, such as for example: texts, drawings, images, photographs, music, sounds, videos, logos and any other material published in any format, including menus, Web pages, the graphics, colors, schemes, tools, fonts, web design, layouts, source code, navigation structure, databases, indexes and software are protected by intellectual property rights of which Italianstories or other subjects are owners. It is forbidden to reproduce, modify, duplicate, copy, distribute, sell, or otherwise exploit the images and contents of the Portal without the prior written authorization of Italianstories and any other owner, including any registered trademarks published. on the Portal itself. Any use of the contents of the Portal for commercial and / or advertising purposes is however prohibited; any violation of this provision may result in criminal or civil penalties.

Under no circumstances may the User alter, change, modify or adapt the Portal, nor the material made available by Italianstories.

7. REGISTRATION
Book the experience you like best, we'll take care of the rest.

The Portal is accessible for viewing some contents without the need for any Registration, however, to fully use the functions of the Platform and access its Services, it is necessary to create Credentials through the Registration process.

Registration can take place:

a) using your account on external Social network websites (such as, for example, Facebook) or
b) directly through the Registration process on the Portal.

Registration for the Craftsman can only and exclusively take place through point b) (Registration process on the Portal).

By authenticating to the Portal through third parties (case a), Italianstories is authorized to access and use the information that is shared through that Service and to use and store the User's credentials in order to allow access to the Portal. The data requested are, among others, the name / surname and an active email address. During the Registration process the User will be required to formulate a User ID and Password necessary to access the Services. At the end of this process the User will receive an email confirming the Registration containing the access data (Credentials). It is therefore advisable to keep this email and not to transfer the information contained therein to third parties.

Artisans and Visitors will have access to their profile through which they can manage their personal data 

the Experiences, as well as all other information and content associated with the profile itself and the Services offered.

In order for the User to use the Portal and the Application, Italianstories will create an account and a profile page of that User, based on the personal data provided. The User cannot have more than one active account. By registering, the User undertakes to: (i) provide updated, complete, accurate and truthful data; (ii) keep your User ID and Password and prevent their use by unauthorized third parties; (iii) inform Italianstories in the event that third parties become aware of the credentials or use them; (iv) to indemnify Italianstories from any and all prejudice that may derive from the violation of the previous points.

Italianstories has the right not to activate or suspend a User's account whenever it deems, at its sole discretion, that the behavior of the same may cause prejudice to Italianstories or to third parties.

Finally, by registering and joining the Service, the Artisan affirms to agree and declares to respect the obligations (including but not limited to administrative, fiscal, labor and safety ones) and declares to be in possession of all licenses, permits, authorizations necessary to propose the Experiences, the Artisan being the sole and exclusive responsible for any consequences that could derive from the violation of these obligations. Furthermore, the Artisan declares that the experience is real and exists. Users therefore understand that Italianstories is not responsible for what is offered in the Artisan Experiences as it does not carry out any kind of prior verification on the Ads, their content and on the Experiences themselves.

8. METHOD OF PUBLICATION OF ANNOUNCEMENTS
Publishing is really very easy, and we will help you if you need it.

To create an Announcement, the Artisan will be asked a series of questions about the Experience being published, the related rules and financial terms. The Advertisements will be made publicly available through the Portal, the Application and the Services. Visitors will be able to book Experiences through the Site, Application and Services based on the information provided in the Announcements.

The Artisan understands and accepts that, when a Visitor requests the reservation of an Experience, he cannot ask him to pay a higher price than that indicated in the reservation request.

The Artisan acknowledges and agrees to be responsible for all Advertisements posted. Consequently, the Artisan declares and guarantees that the Advertisements he will publish will comply with all applicable laws, rules and regulations and tax requirements, and do not in any way infringe the rights of third parties.

Users understand and accept that Italianstories limits itself to relating the parties for the conclusion of the contract, in the absence of any bond of collaboration, dependence or representation with respect to the same. Any agreement concluded between Users is an agreement between the Artisan and the Visitor and Italianstories is not part of that agreement. Regardless of the foregoing, Italianstories acts as a representative for the collection of payments as authorized by the Artisan in order to receive, on his behalf, payments from Visitors within the limits of the amount.

Users also understand that Italianstories does not carry out any kind of prior verification on the Ads, their content and the Activities proposed by the Artisans.

9. BOOKING METHODS AND FINANCIAL TERMS
We handle the payment. So neither the seller nor the buyer risks anything.

9.1 Determination of the Price of the Experience

The Price of the Experience is not established by Italianstories but by the craftsman who proposes it. It varies based on: number of participants, type and duration of the Experience. The Price of the Experience will be indicated to the Visitor before sending the booking request to the Artisan.

9.2 Booking of the Experience and completion of the Transaction

The Artisans are solely responsible for honoring any reservation confirmed through the Site, Application and Services. The Visitor understands and accepts that he will be required to conclude an agreement with the Artisan and acknowledges and accepts that the responsibility for the fulfillment of the obligations of this agreement falls on the latter, and not on Italianstories, which is not to be considered in in no way part of these agreements and, except for the payment obligations under these Conditions, excludes any liability deriving from or relating to such agreements.

Each registered Visitor can book the announcements of the Experiences provided through the Service. Once the booking request has been made, the Craftsman receives a warning message and is required to confirm or reject this booking 

within twenty-four (24) hours of its submission through the Portal. When a reservation is requested through the Portal, Italianstories shares with the Artisan concerned the name, surname and a link to the profile page of the Account of the Visitor who requested the reservation, so that the Artisan can view this information before confirm or reject the booking request.

When booking an Experience, Italianstories will ask the Visitor to pay the Total Price of the Experience through one of the payment methods made available.

If the requested reservation is not accepted, any amount collected by Italianstories will be returned to the Visitor and any pre-authorization, if applicable, of the Visitor's credit card will be released.

If the booking is confirmed by the Artisan, each Visitor undertakes to pay Italianstories the Total Price of the Experience of any booking requested and confirmed by the relevant Artisan by charging the credit card provided within the booking request process. . In order to fix a reservation pending confirmation from the Artisan, the Visitor understands and accepts that Italianstories, in the name and on behalf of the Artisan, reserves the right, at its sole discretion, to (i) obtain a pre-authorization by means of your credit card for the Total Price of the Experience, or to (ii) charge your credit card a nominal amount, not exceeding one euro, in order to verify the credit card. At the end of the booking procedure, the Visitor will receive a confirmation communication (by email), which will indicate a unique code (called "order request code"), which the Visitor will be responsible for keeping in place and in a secure manner. , and essential information relating to the chosen Experience.

Italianstories will collect the Total Price of the Experience, the transaction will be completed and Italianstories will send the Artisan and the Visitor an email confirming this reservation.

9.3 Payments

Users accept that Italianstories will act as a representative for the collection of payments from the Artisan for the exclusive purpose of accepting payments from the Visitor in the name and on behalf of the Artisan; the Visitor's obligation to pay towards the Artisan ends with the payment of the Price of the Experience to Italianstories.

The payment of the Experience Price, already authorized by the Visitor with the sending of the booking request, is processed by Italianstories, or by the third party that processes the payments, upon confirmation of the Experience's booking by the Craftsman. Following the crediting of the Price of the Experience, Italianstories will issue a specific invoice for the amount of the Commission charged to the Artisan.

As part of the booking process, the visitor will be offered as a payment method: i) payment via a secure system ("Paypal").

Italianstories transfers to the Artisan the Price of the Experience (Total Price of the Experience separated from the Visitor's Commission) for Experiences completed by at least twenty-four (24) hours (except in case of reimbursement to the Visitor). The time it takes for the Owner to receive payments may vary depending on the method of receiving the payment chosen.

Through these Conditions, the Artisan appoints Italianstories as its representative for the collection of payments for the exclusive purpose of receiving the Price of the Experience from the Visitors. Italianstories assumes no responsibility for any actions or omissions of the Artisan.

The Artisan accepts that the payment made by a Visitor through Italianstories will be considered as a payment paid to him directly. The Artisan also accepts that Italianstories can: (i) allow the Visitor to cancel the reservation and (ii) refund the Visitor (through Italianstories) that percentage of the Experience Price defined in the refund policy. Each Artisan understands that the obligation of Italianstories to pay the Artisan is subject to and conditional upon receipt of the payment by the Visitor. The Owner does not guarantee payments in favor of the Artisans for the amounts whose payment has not been correctly made, by the relative Visitors, in favor of Italianstories.

10. BOOKING TIME AND ACCEPTANCE OF AN EXPERIENCE
Check the time for last minute bookings!

In the case of booking close to the Experience, these time limits apply:

for an Experience that starts between 8.00 am and 2.00 pm, the booking deadline is 9.00 pm on the previous day and the deadline for confirmation by the Craftsman is 11.00 pm of the previous day;

for an Experience that begins between 2.00 pm and 8.00 am, the booking deadline is 8.00 am of the same day and the deadline for confirmation by the Craftsman is 10.00 am of the same day.

11. FEES
How does Italian Stories make money?

As consideration for the use of the Platform, Italianstories charges the payment of Commissions. Where applicable, Taxes (such as VAT) may also be charged in relation to the Craftsman's Fees and the Visitor's Fees. Italianstories deducts the Artisan's Commissions from the Price of the Experience before paying the remuneration to the Artisan as described in these Conditions. Visitor Fees are, as previously indicated, included in the Total Experience Price.

The balance relating to the Experience will be paid by Italianstories to the Artisan by means of PayPal or bank transfer, depending on the methods that the Artisan selects through the Portal.

Please note that Italianstories may apply or deduct foreign currency processing costs on or from any payment made or received in currencies other than the Euro. Except as otherwise provided in these Terms, Fees are non-refundable.

12. CANCELLATIONS, WITHDRAWAL AND REFUND POLICY
If you are a visitor, you can always cancel and we will refund you a part. If, on the other hand, it is the Artisan who cancels, as a Visitor you will be refunded 100%.

12.1.1 Revocation by the Visitor

If the Visitor cancels a requested reservation before it is confirmed by the Artisan, Italianstories will cancel any previous authorizations on his credit card and / or refund all nominal sums charged to his credit card in relation to the requested reservation within a period commercially reasonable time.

The Visitor who intends to revoke a reservation made can do so from their user wall and wait for a response that confirms this cancellation. In the event that the Visitor does not receive this confirmation, he must contact Italianstories directly at the email support@italianstories.it.

The Visitor Fee is non-refundable.

In the event that the Visitor becomes responsible for Critical Issues: i) not showing up at the place and on the agreed date for the Experience; ii) arriving more than 15 minutes late from the start date of the Experience; iii) concluding the Experience prematurely by his spontaneous choice, he will not be entitled to any refund.

In some circumstances, Italianstories may decide, at its sole discretion, that it is necessary or preferable to cancel a reservation made through the Portal.

12.1.2 Right of withdrawal for the Visitor

If the Visitor intends to withdraw from a reservation already confirmed through the Portal, the methods for making the withdrawal are as follows:

a withdrawal from 0 to 48 hours before the Experience corresponds to a refund of 0% *;

a withdrawal from 48 hours to 7 days before the Experience corresponds to a refund of 50% *;

a return of more than 7 days before the Experience corresponds to a refund of 100% *.

(*)% regarding the Price of the Experience. The cost of the money transfer operation (formerly Paypal), independent of Italianstories, will be subtracted from this percentage, which in any case will not exceed 4%.

The Visitor who intends to cancel a reservation made can do so from their user wall and wait for a response that confirms this cancellation. In the event that the Visitor does not receive this confirmation, he must contact Italianstories directly at the email support@italianstories.it.

12.1.3 Provision of reimbursement for the Visitor

The Visitor who deems he has suffered a Criticality by the Craftsman, ie when the latter: i) cancels the Experience with less than forty-eight (48) hours' notice; ii) does not show up at the place and date agreed for the Experience; iii) realizes a discordant Experience from what is described on the Site; will report it to Italianstories as indicated below, which will evaluate the case at its own discretion. If Italianstories deems the Criticality of the Experience to exist, it may, at the Visitor's choice, (i) reimburse the amount paid through the Service, according to the percentage determined by Italianstories and based on the nature of the Criticality, or (ii) do what its power to find and / or book instead of the Visitor an Experience alternative to the original one but comparable in terms of duration, place, content, characteristics. All decisions of Italianstories regarding the Refund Policy, including the amount itself, will be final and binding for the Users.

To send a valid complaint about a Criticality of the experience, the Visitor must strictly perform all the following actions:

inform Italianstories by sending an email to support@italianstories.it, and providing the reasons regarding the Criticalities that emerged no later than twenty-four (24) hours from the starting time of this Experience, and undertaking to provide Italianstories with any necessary clarification;

demonstrate that they are not responsible, directly or indirectly, by action, omission or negligence, for this Criticality.

All decisions made by Italianstories regarding the method and amount of reimbursement for Visitors will be final and binding for Users.

The Visitor who is not satisfied with the quality of the Experience cannot ask for a refund of the same to Italianstories, but can make it explicit by writing a review on the Artisan, who is aware that a high score of his reviews is directly related to an increase. of your reservations.

12.2.1 Cancellation and withdrawal by the Artisan

The Artisan can cancel, without any penalty, an Experience published by him that has not yet obtained reservations.

The Craftsman with at least forty-eight (48) hours' notice with respect to the date and time of the Experience, can withdraw without penalty a reservation confirmed by himself through his user bulletin board and wait for a reply that confirms such withdrawal. In the event that the Artisan becomes responsible for Critical Issues: i) canceling the Experience with less than forty-eight (48) hours' notice; ii) failing to show up at the place and date agreed for the Experience; iii) realizing an Experience that differs from what is described on the Portal, he agrees to reimburse Italianstories the same amount referred to the Total Price of the Experience or to renounce the amount collected by Italianstories for his name and account, also with reference to future collections , until the amount to be reimbursed is reached.

Italianstories, in the event of repeated Criticisms by the Artisan, may retaliate against the Artisan by taking any action necessary to resolve such incorrect behavior including i) post a review on his Ads indicating that a reservation has been canceled, ii) make the calendar of User advertisements not available or blocked for the dates affected by the canceled reservation, or iii) impose a penalty (to be withheld from future payments intended for him). If the Artisan decides to cancel a reservation, he is required to notify Italianstories at the email office@italianstories.it and he will be informed of the circumstances under which the payment of a penalty may apply.

In some circumstances, Italianstories may decide, at its sole discretion, that it is necessary or preferable to cancel a reservation made through the Portal.

If an Artisan withdraws from a confirmed booking through the Portal, the Visitor may ask Italianstories at his choice: (i) the reimbursement of the Total Price of the Experience for such cancellation within a commercially reasonable period of time from the cancellation or (ii) ) the offer of an alternative Experience to the original one but comparable in terms of duration, place, content, characteristics. The Visitor will receive an email or another communication from Italianstories containing alternative experiences. Any Visitor who has not received any email or other communication from Italianstories following the cancellation of a confirmed booking by a craftsman is requested to contact Italianstories at the email support@italianstories.it.

12.2.2 Refunds for the Craftsman

If the Visitor wishes to withdraw from an Experience already confirmed by the Artisan, the percentage of the Experience Price that will be recognized to the Artisan will be as follows:

a refund of 0% ** corresponds to a withdrawal more than 7 days before the Experience;

for a withdrawal from 48 hours to 7 days before the Experience there is a refund of 50% **;

a withdrawal from 0 to 48 hours before the Experience corresponds to a refund of 100% **.

In case of non-presence of the Visitor in the place and on the date agreed for the Experience, the Artisan will be entitled to a 100% refund **

12.3 Bad weather

In the event that the weather conditions do not make the Experience feasible, the Craftsman can propose an alternative date to carry out this Experience. If an agreement cannot be found, the Visitor will be refunded 100% of the Total Price of the Experience.

12.4 Events

As regards the Events purchased through the Portal, no refund is provided in the event that the User cannot participate in the Event.

13. DISCLAIMER OF LIABILITY
We do our best to make sure that all information we provide is correct but sometimes, independently of us, there may be errors.

THOSE WHO CHOOSE TO USE THE ITALIAN STORIES SITE, APPLICATION AND SERVICES ARE AWARE OF THE RISKS THAT THEY ASSUME.

Unless expressly indicated otherwise on the Portal, the obligations of Italianstories are limited to: (i) making the Portal and the Service connected to it available; (ii) act as a representative for the collection of payments of each Artisan by the Visitors.

Italianstories has no responsibility for the fulfillment of the obligations assumed by the Users through the Portal, as it exclusively provides the Service without being a party to the Transactions.

Italianstories does not verify the truthfulness of the information provided by Users for registration or the Ads. Therefore, the User is solely responsible for assessing the identity of other Users and the suitability of the Ads accessed through the portal. Italianstories will not be liable for any damage or prejudice arising from interactions between Users, including, by way of example only, the obligations arising from the Transactions, the prejudices arising from the non-compliance of the Experience with what was agreed or from the failure to improve the Experience.

The indications from the Portal on Users do not constitute an endorsement, certification or guarantee by Italianstories on their identity and their reliability. In booking and accepting Experiences, in finalizing Transactions and in general interactions between them, Users undertake to always adopt due diligence and attention.

USERS ARE SOLELY RESPONSIBLE FOR ALL COMMUNICATIONS AND INTERACTIONS WITH OTHER USERS OF THE PORTAL, APPLICATION OR SERVICES AND WITH OTHER PEOPLE WITH WHOM THEY COMMUNICATE.

Since Italianstories cannot check the topics covered and the contents published or exchanged, it declines all responsibility in relation to the Announcements and Transactions completed through the Service, of which it is not a part and cannot be held responsible in any way. Italianstories does not guarantee that the Portal and the Services are suitable for use by any person or accessible at any time or in any geographic area, but will undertake, to the extent reasonably possible, any useful action to maintain the availability of the Portal and its functionality. of the Services to the extent provided for in these Conditions. 14. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no case will Italianstories or its third party licensors and its suppliers or collaborators be liable towards the User or third parties, for direct, indirect, consequential, incidental, special or punitive damages or for loss. of any kind, including, without claiming to be exhaustive, loss of performance, income, profit, loss of contracts, business interruption, loss or corruption of data, whatever the cause and regardless of whether it occurs in place of contract or for tort, including negligence, even if Italianstories has been warned of the possibility of such damages.

If a limitation, exclusion, restriction or other provision contained in these Conditions is judged void for any reason whatsoever by the judicial authority and Italianstories becomes as a consequence responsible for loss or damage the entity of which may be legitimately limited, such liability, whether it is in the contractual, civil or other context, it cannot exceed the amount of 100.00 euros.

Some states / jurisdictions do not allow the exclusion of implied warranties; therefore, the above exclusion may not be applicable to the User, who may therefore be the owner of other rights established by law which may vary from state to state or for different jurisdictions.

17. DURATION OF THE RELATIONSHIP AND WITHDRAWAL

The contract that is stipulated between Users and Italianstories for the use of the Service is for an indefinite period starting from the moment in which the registration by Italianstories is accepted.

The Visitor can withdraw from the contract at any time by canceling his registration by sending a written communication to support@italianstories.it.

The Artisan can withdraw from the contract by canceling his Registration, by sending a written communication with 60 days notice by registered letter with return receipt or by PEC to the following email address: italianstories.srls@legalmail.it.

With the cancellation of the User account, Italianstories is free to delete all User Content that may be present on the Portal.

18. CHANGES
If necessary, we can modify this document.

These Conditions can be modified at any time. Any changes and / or new conditions will be effective from the moment of their publication in this section of the Portal. The "Last Updated Date" at the beginning of these Terms will be modified accordingly. 22.2 Notifications and communications

Any notification or other communication required under these Conditions will be made by e-mail (to the address provided by the User), by telephone (through the agreed and available technology (eg Skype) or by publication on the Portal. notifications via email, the date of receipt will be considered the date on which this notification is transmitted, while those published on the Portal are understood to be received at the first useful access made by the User according to the procedure prepared by Italianstories which requires it to be displayed.

22.3 Insurance

Italianstories advises the Artisan who does not have one to take out adequate insurance for the Experiences indicated in the Announcements. If the Artisan is provided with it, Italianstories asks him to carefully analyze any insurance policy in his possession.

22.4 Language

The original text of these Conditions is in Italian, but may have been translated into other languages. The translated version is to be understood as unofficial and for illustrative purposes only, therefore without legal value. In the event of disputes or inconsistencies or discrepancies between the Italian text and the translations into other languages ​​of these Conditions, the Italian text will prevail and will be the version on which to rely.

SPECIFIC CONDITIONS FOR ARTISANS
As a craftsman we ask you only this.

In order to use the Platform and publish his Ads, the Artisan, in addition to the foregoing, acknowledges and agrees to respect the following rules:

the Artisan renounces to indicate in the communications, instructions, messages that he will send to Visitors through the Portal his own address and telephone contact, email and any information suitable to promote his direct contact with the Visitor;

the Artisan is required to reimburse Italianstories the Total Price of the Experience in the event of your misconduct and / or Criticality (for example: your cancellation of bookings / activities within forty-eight (48) hours from the appointment, non-presence at the place and on the agreed date, duration of the Experience significantly lower than that established or discrepancy from what is described on the Italianstories website);

the Artisan undertakes to guarantee Parity Rates to Italianstories (the price on the Site, for the same type of offer, must be better than or equal to that possibly proposed on its website.);

the Artisan undertakes to guarantee exclusivity for the online sale of one's activities / experiences (not of one's own artifacts) compared to other websites, excluding one's own, for the entire duration of the contract.
